During the  early stages of a project, Consultant design teams, can inadvertently, develop a Projects design in isolation and constraints such as buildability, site conditions, resource availability and current market pressures are not normally considered, but have a high-cost and programme impact.

Typically a project is ready for tender, a Development Approval has been granted, pre-sales and/or tenants have been secured, commitments to Financial Partners have been made and the Projects design is effectively locked in. 

It has been our experience that uneconomical and difficult to construct Project designs have been developed  with  limited  opportunities to amend without substantive risks of delaying a project due to likely resubmissions to the Approving Authority (section 4.55 etc).

Recent legislation amendments, particularly in the Residential sector, has seen major behavioral changes from Private Certifiers and Designers, requiring Initial CC documentation to be precisely consistent with the final constructed form.

The combination of risks associated with Approvals, Legislation and Delays to programme means that the project proceeds with non retrievable and embedded lost value.

Early Contractor Involvement (ECI) is a form of contracting that should address these risks, however, it would seem that there is a consensus amongst Developers that the value derived from an ECI engagement has not been realised due to trust with the Contractor being diminished as separate agendas emerge during the ECI engagement.
